Terms and Conditions of Use

The Terms and Conditions of Use set forth herein apply to ("the Site") owned, operated, or controlled by China Unipath.

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THE SITE.

By using the Site and/or purchasing any China Unipath products, I (being the user of this Site) signify my assent to these terms of use. If I do not agree to these terms of use, I will not use the Site or purchase any China Unipath product. China Unipath reserves the right, at its discretion, to change, modify, add or remove portions of these terms at any time. I will check these terms periodically for changes. My continued use of the Site following the posting of changes to these terms will mean I accept those changes.

Disclaimer

I understand that the materials on the Site are provided "as is" and without warranties of any kind either express or implied. To the fullest extent permissible by applicable law, China Unipath disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. China Unipath does not warrant that the Site or the server(s) that makes the Site available are free of viruses or other harmful components. China Unipath does not warrant or make any representations regarding the use or the results of the use of the materials in this Site as to their correctness, accuracy, reliability, or otherwise. I (and not China Unipath) assume the entire cost of all necessary servicing, repair, or correction. I further agree that no oral or written information or advice given by China Unipath or an authorized representative shall create a warranty of any kind. Applicable law may not allow the exclusion of implied warranties, so certain of the above exclusions may not apply to me.

Release

I agree to waive and release all claims against China Unipath (which term shall include officers, directors, the company itself, employees and agents of the company, as well as host institutions and any person or entity employed or utilized by China Unipath) arising from, or in connection with, any physical or property damage or loss, accidents, delays, irregularities, or other occurences which I may suffer from any cause including acts of God, strikes or government restrictions, war, terrorists activities, sickness or quarantine or the acts or omission of any other agents over which such persons have no direct control, including, without limitation, airlines, transportation companies and railways, bus companies, taxi services, general road traffic, restaurants, student residences, apartments, youth hostels, hotels or host families.

I understand that I am responsible for taking all measures and exercising caution and common sense at all times to avoid injuries and/or death.

I hereby waive and release all claims against China Unipath and its agents arising at any time during the program, (whether I am or am not under the direct supervision of China Unipath or its agents), and I agree to indemnify China Unipath and its agents against any consequences thereof.

Rules of Conduct

China Unipath or the host institute shall have the right to enforce appropriate standards of conduct and that it may at any time terminate my participation in its program for failure to maintain these standards or for any actions or conduct which China Unipath or the host institute considers to be incompatible with the interest, harmony, comfort and welfare of other students, staff, or the laws of the People's Republic of China. I shall have no right to any refund of any part of my program fee upon termination of my participation from the program and that upon notice by China Unipath, whether verbally or in writing, I shall forthwith depart from the program and to return home at my own expense.

Cancellation & Refund Policy

A refund is granted or declined in accordance with the policies and situations set forth below:

My application, required documents and payment for China Unipath services are submitted to and confirmed by China Unipath AFTER the deadline as indicated on the course schedule. However, China Unipath is unable to enroll me into my chosen program due to factors beyond their control. Then:

My refund = Service fee less 170 USD

Please be aware the 50 USD late application fee that is to be paid in addition to the service fee during application is not refundable.

(Note: Under most circumstances of late application, China Unipath is able to successfully enroll an applicant into their chosen program. However, China Unipath will be unable to provide students with the 'Visa Application for Study in China' document to apply for a study visa in their local embassy.

If this is the case, students can travel first to China on an L travel visa, and then update their visa in the first few weeks after their arrival. Please be aware the additional expenses incurred to obtain this updated visa will be the responsibility of the student.

In this situation where enrollment has not failed, NO refund to the student can be issued.)

My application, required documents and payment for China Unipath services are submitted to and confirmed by China Unipath BEFORE the deadline as indicated on the course schedule. However, my personal profile does not meet the requirements of the host university or language school and/or the Chinese government and embassy, which in turn results in the failure of my admission. Then:

My refund = Service fee less 170 USD

My application, required documents and payment for China Unipath services are submitted to and confirmed by China Unipath BEFORE the deadline. If in the rare case of negligence of China Unipath staff results in the failure of my admission to my chosen program, then:

My refund = Service fee

My application, required documents and payment for China Unipath services are submitted to and confirmed by China Unipath. China Unipath successfullly enrolls me into my chosen program. However, due to unforeseen reasons (owing to change of mind, financial/legal difficulties or otherwise), I am unable to participate and must withdraw from my chosen study program. Regardless of any portions of my program unattended:

No refund can be issued

If deemed necessary or desirable by China Unipath or its agents to advance or loan any monies to me or incur special expense on my behalf while I am abroad, I (and/or my family members) agree to make immediate repayment prior to or upon my return.

If you provide information to China Unipath on or through this Site, China Unipath will use it in accordance with the terms of its privacy policy. That privacy policy forms part of these Terms and Conditions and by using this Site you acknowledge and agree that you have read and accept the terms of that privacy policy.

Passport & Visa

I understand and accept that it is my responsibility to obtain a valid passport and visa for my entry into China, and in the event that I cannot obtain the passport and/or visa for participation, and/or have been refused visa entry by my local Chinese embassy, I shall not hold China Unipath responsible. Failure to secure the necessary travel documents such as passports or visas does not constitute grounds for a refund.

Safety, Health and Insurance

I expressly acknowledge and agree as a condition of traveling on a China Unipath program that I (and anyone claiming through me) shall have no rights whatsoever, directly or indirectly, under any theory at law or in equity against China Unipath. I understand that insurance is my sole responsibility and that China Unipath will not obtain any insurance for me on my behalf.

I hereby grant China Unipath and its agents full authority to take whatever actions they may consider to be warranted due to any international or political unrest, personal emergency or other event regarding my health and safety, and I fully release each of them from any liability for such decisions or actions as may be taken in connection therewith.

I authorize China Unipath and its agents at their discretion to place me at my own (or my family members') expense and without my further consent in the hands of a local Chinese or international medical service and treatment. If deemed necessary or desirable by China Unipath or its agents, I authorize them to transport me back to my home country by commercial airline or otherwise at my own (or my family members') expense for medical treatment.

Pricing

China Unipath service fees are subject to change. I understand that China Unipath reserves the right to adjust their published prices for any reason at any time. However, China Unipath will not adjust prices once my application has been submitted and confirmed, and the amount I pay will be in accordance to prices prior to the change.

Payment

I agree to make payment to China Unipath for my selected service option within five business days of receiving their confirmation email for my application. In the event where I exceed this deadline, I understand that China Unipath will discard my application and I will be required to re-submit a new application.

Copyright Issues

I understand that this site is owned and operated by China Unipath and unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of China Unipath, Copyright © 2006-2008, ALL RIGHTS RESERVED. I may use the content of this site only for the purpose of applying for a China Unipath product and for no other purpose. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without China Unipath's prior written permission.
I understand that from time to time China Unipath's publicity material may include statements by its students and/or their photographs, and I consent to such use of my comments and photographic likeness. I further agree to the release of my name and home country to other participants.

These terms and conditions cannot be modified or interpreted except in writing and that no oral modification or interpretation shall have any validity.

This agreement shall become effective when my application is accepted by China Unipath, and shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws of Hong Kong and/or the People's Republic of China applicable thereto (at the choice of China Unipath).
